  • “Tradesperson” or “Tradespeople” refers to the individual or individuals appointed by H&M Locksmith and Building Services Ltd. to carry out the work.

4. Hourly Rate Work

The total amount payable for work charged at an hourly rate will consist of the following:

4.1 Labour

Labour charges cover the time spent by the tradesperson carrying out the work, including reasonable time spent obtaining non-stocked materials where necessary. Labour will be charged in accordance with our current hourly rates.

Only time reasonably related to your work will be charged. Breaks, including lunch breaks, will not be chargeable.

4.2 Materials

Materials supplied by us will be charged at the trade purchase price plus a mark-up of up to 25%.

4.3 VAT

All charges are subject to VAT at the prevailing rate, except where the work qualifies for zero-rating under applicable VAT regulations.

5. Fixed-Price Work

Where we agree to carry out work for a fixed price, the agreed price will cover the specific work and materials expressly included in the quotation or written agreement.

Any additional work, changes to the agreed scope, or unforeseen requirements may incur additional charges. Where possible, we will notify you of any additional costs and obtain your agreement before proceeding.

The terms relating to the parties and their responsibilities, as set out in Section 3, also apply to fixed-price work.

6. Offers and Incentives

All offers, discounts and incentives are provided at our discretion.

There is no fixed percentage applicable to discounts, and we are not obliged to offer a discount on any service. Any discount offered may vary depending on the nature, scope and requirements of the work.

Offers and incentives may be used in conjunction with other offers only where we expressly permit this.

7. Invoices and Payment

7.1 Deposits

At our discretion, we may require a deposit of up to 70% of the agreed price. Where a deposit is requested, the payment terms will be communicated to you and the deposit must be paid in accordance with those terms before work proceeds, where applicable.

7.2 Invoicing and Payment Terms

Upon completion of the work, we will issue an invoice for the outstanding amount.

Unless otherwise agreed in writing, payment must be made in full within 30 days of the invoice date. Late or non-payment may result in further action being taken to recover outstanding amounts, subject to applicable law.

7.3 Responsibility for Payment

Unless you inform us at the time of placing your order that you are acting on behalf of a third party, you will be solely responsible for ensuring that all invoices are paid in full.

Where you instruct us to carry out work on behalf of another person or organisation, the payment arrangements and the identity of the responsible party must be disclosed and agreed upon in advance.

8. Timekeeping and Delays

Where a date and/or time has been agreed for work to be carried out, we will make reasonable efforts to ensure that our tradesperson arrives at the agreed time.

However, appointment times may be affected by circumstances beyond our reasonable control, including delays in previous jobs, traffic, emergencies or late or non-delivery of materials.

Where a delay arises from circumstances beyond our reasonable control, we will not be responsible for the delay or its consequences to the extent permitted by law. We will be entitled to a reasonable extension of time to fulfil our obligations where appropriate.

We will make reasonable efforts to keep you informed of significant delays.

9. Cancellations and Rearrangements

If you wish to cancel or rearrange a booking, you must notify us before 7:00 pm on the day before the scheduled appointment.

If you cancel after this deadline, or after work has commenced or materials have been ordered or supplied, you may be liable for reasonable costs already incurred by us, including labour, materials and other applicable costs.

Where legally recoverable, these charges may also include reasonable costs arising from the cancellation in accordance with the original instructions.

Nothing in this section excludes or limits any cancellation rights you may have under applicable consumer protection legislation.

10. Customer Satisfaction and Complaints

H&M Locksmith and Building Services Ltd. is committed to providing professional, high-quality services to all our customers.

If you are dissatisfied with any work carried out by us, you should notify us in writing as soon as reasonably possible, and preferably within 12 months of completion.

You must give us a reasonable opportunity to inspect the reported issue and, where appropriate, allow us and our insurers to assess the matter and carry out any necessary remedial work.

We may not be responsible for defects or issues that arise from circumstances outside our control or that have been caused or worsened by third-party work, misuse, neglect or unauthorised alterations, subject to applicable law.

Nothing in this section affects your statutory rights.

11. Guarantee

11.1 Workmanship Guarantee

We provide a 12-month guarantee on labour carried out by H&M Locksmith and Building Services Ltd. This guarantee covers faulty workmanship and begins on the date the relevant work is completed.

This guarantee is in addition to any manufacturer’s warranty that may apply to products or materials supplied by us.

11.2 Circumstances Where the Guarantee May Not Apply

Our workmanship guarantee may not apply where the relevant work, installation or appliance has been:

  • Subjected to misuse, neglect or negligence.

  • Repaired, modified, altered or tampered with by anyone other than our authorised tradespeople.

  • Affected by defects in materials supplied by you or by circumstances outside our control.

We do not accept responsibility for the suitability of materials supplied by you, although nothing in these Terms and Conditions limits liability that cannot lawfully be excluded.

11.3 Excluded Work

Our workmanship guarantee does not cover:

  • Blockages in waste or drainage systems.

  • Work undertaken against the written or verbal advice of our tradesperson.

  • Work that has not been carried out by us.

  • Defects arising from related or advised work that we recommended but that was not subsequently completed by us.

Only work carried out by us and paid for in full is covered by our workmanship guarantee, subject to the terms of this section and applicable law.

11.4 Existing Installations and Older Equipment

Where we agree to work on installations of lower quality or installations that are more than 10 years old, we may be unable to guarantee their overall performance, suitability or effectiveness.

Any limitations relating to such work will be explained to you before the work proceeds. This provision does not exclude liability for our own faulty workmanship where such liability cannot lawfully be excluded.

12. Liability

12.1 Responsibility for Our Work

We will be responsible for addressing defects in our own workmanship in accordance with the applicable guarantee and these Terms and Conditions.

We will not be responsible for problems arising from additional work that we recommended but that you declined or instructed us not to complete, except where such liability cannot lawfully be excluded.

12.2 Work Not Covered by Our Guarantee

We will not be responsible for damage or defects arising from work that falls outside the scope of our guarantee, including work carried out by third parties or work undertaken against our recommendations, except to the extent that applicable law provides otherwise.

Where our tradesperson or office staff have informed you that particular work is not guaranteed, the relevant limitation will apply to the extent permitted by law.

12.3 Negligence and Reimbursement

Where the negligence or poor performance of a tradesperson results in H&M Locksmith and Building Services Ltd. becoming liable to pay for damage or remedial work, we reserve the right to seek reimbursement from the responsible party where legally permitted.

12.4 Gas Safety

Any Gas Warning Notice issued by one of our tradespeople, or any hazardous situation identified in connection with gas installations, must be taken seriously.

You are responsible for ensuring that any safety recommendations or remedial actions communicated to you are addressed promptly. Failure to follow safety advice may expose you or others to risk.

Our gas-related work is carried out by appropriately registered professionals where registration is required. Responsibility for gas-related work and any resulting liability will be determined in accordance with applicable legislation and the circumstances of the case.

Nothing in this section excludes or limits any liability that cannot legally be excluded or restricted.

13. General Terms

13.1 Amendments to These Terms

These Terms and Conditions may only be waived, amended or varied by a written agreement signed by you and an authorised representative of H&M Locksmith and Building Services Ltd.

13.2 Conflicting Terms

Unless otherwise agreed in writing, these Terms and Conditions will take precedence over any terms and conditions contained in documents supplied by you, to the extent permitted by applicable law.

13.3 Governing Law and Jurisdiction

These Terms and Conditions, together with any contract entered into between you and us, will be governed by and interpreted in accordance with the laws of England and Wales.

The courts of England and Wales will have jurisdiction over disputes arising from these Terms and Conditions, subject to any mandatory legal provisions that may apply.
